1. Introduction

Welcome to Respony. These Terms of Service ("Terms") govern your access to and use of the Respony platform, website, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

Respony is an AI-powered customer research platform that enables users to create conversational surveys, collect responses, and analyze data through artificial intelligence.

"Service" refers to the Respony platform, including but not limited to the website (respony.com), AI-powered survey generation, respondent interface, analytics dashboard, and all related features.

"User", "You", "Your" refers to any individual or entity that accesses or uses the Service.

"Researcher" refers to users who create and manage research projects on the platform.

"Respondent" refers to users who participate in surveys and provide responses.

"Content" refers to all text, data, information, survey questions, responses, and other materials submitted to or generated by the Service.

3. Account Registration and Eligibility

3.1 Eligibility

To use our Service, you must be at least 18 years old or the age of majority in your jurisdiction, whichever is greater. By creating an account, you represent and warrant that you meet these eligibility requirements.

5. Subscription and Payment

Respony offers subscription plans as described on our website. Prices are subject to change with notice. Current pricing and plan details are available at respony.com.

5.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for recurring fees until you cancel.

5.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

5.4 Refunds

Refund requests may be considered on a case-by-case basis within 14 days of purchase. To request a refund, contact support@respony.com with your account details and reason for the request.

6. Intellectual Property

The Service, including all content, features, functionality, software, designs, and trademarks, is owned by Respony and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of the Content you submit to the Service. By submitting Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and display such Content solely for the purpose of providing the Service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESPONY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Respony and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of Poland.
